Federal Court Mandates Release of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment lacks legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.
The case originates in a erroneous removal to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to face human smuggling allegations, he was detained in federal custody.
In her decision, the judge noted that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."
